⚖️ Terms and Conditions for Private Sales

1. Scope of Application

These Terms and Conditions (T&C) apply to all private sales made by Lionel Steidel (hereinafter referred to as "the seller") through this online platform.
By placing an order, the buyer confirms that they have read and agreed to these terms.

Please note: This is a private sale, not a commercial or business transaction.

3. Nature of Sale

All items are sold privately and without any commercial intent.
The seller is not a registered business and does not issue invoices with VAT.
Each sale is made on a personal, one-time contractual basis between private individuals.

4. Product Information and Presentation

• Product photos, descriptions, and specifications are for illustration purposes only and may differ slightly from the actual item.

• Minor differences in color, size, design, or packaging are not grounds for complaint or refund.

• The buyer acknowledges that the product may vary slightly from the online images or their personal expectations.

• The seller accepts no liability for such differences.

By purchasing, the buyer agrees to accept the product as described in the offer.

5. Condition of Goods and Warranty Exclusion

All items are sold "as is" (as seen) and without any warranty or guarantee.
To the fullest extent permitted by Swiss law, no liability is accepted for material defects, product quality, or suitability for any particular purpose.

The statutory warranty (Art. 197 et seq. OR) is excluded in accordance with Art. 199 OR.
This means: the buyer purchases the item at their own risk and waives any right to complaint, exchange, or return.

6. Returns and Refunds

Because this is a private sale, returns, exchanges, and refunds are excluded.
Once the purchase is confirmed, the sale is considered final.
Exceptions apply only if the seller has expressly and in writing agreed to a return before the item was shipped.

7. Liability

The seller shall not be liable for any direct, indirect, or consequential damages, including dissatisfaction, improper use, delays, or losses of any kind.
Total liability — if applicable — is limited to the purchase price of the item.

8. Delivery

Shipping times may vary depending on the supplier or logistics provider.
Delays due to customs, postal services, or third parties do not entitle the buyer to cancellation or compensation.

9. Data Protection

Personal data provided during the purchase process will be used only for communication and delivery purposes.
No personal data will be shared with third parties unless necessary for shipping or payment.

10. Governing Law and Jurisdiction

This private sales agreement is governed exclusively by Swiss law, excluding the UN Convention on the International Sale of Goods (CISG).
The exclusive place of jurisdiction is 4460 Gelterkinden (BL), Switzerland.
